Terms of Use (EULA)

1. Acceptance of Terms

By downloading, installing, or using the Kiddio mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and 4our5ive Software Inc. ("Kiddio," "we," "our," or "us") regarding your use of the App and related services.

2. Description of Service

Kiddio is a mobile application that helps Canadian families discover children's activities, programs, and events. We aggregate activity information from 85+ recreation providers across 80+ cities in Canada, providing access to over 126,000 activities. Our services include:

Core Features (All Users)

• Activity discovery and search with filters (age, location, price, schedule, activity type)
• Interactive map view with geocoded activity locations
• Child profile management with preferences
• Favorite activity saving (per child)
• Calendar integration with enrolled activities and custom events
• Activity watching/waitlist for availability notifications
• Push notifications for reminders and updates

Pro Features (Subscription Required)

• AI-powered personalized activity recommendations
• AI Chat assistant for conversational activity discovery
• AI Weekly Planner for optimized family schedules
• Unlimited child profiles
• Family sharing (share child profiles with other family members)
• Advanced filtering and search options
• Priority customer support

3. User Accounts

Account Creation

To access certain features of the App, you must create an account using a valid email address. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at support@kiddio.fun.

Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

Child Profiles

You may create child profiles within your account to receive personalized activity recommendations. You represent that you are the parent or legal guardian of any children for whom you create profiles, or have obtained proper consent to do so.

4. Subscriptions and Payments

Free and Pro Tiers

The App offers both free and paid ("Kiddio Pro") subscription tiers. Free tier users have access to basic search and filtering features with limitations on AI features. Pro subscribers have access to unlimited AI recommendations, AI Chat, Weekly Planner, and family sharing features.

Subscription Terms

• Subscriptions are available on monthly or annual billing cycles
• Payment is processed through the Apple App Store (iOS) or Google Play Store (Android)
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage and cancel subscriptions through your device's app store settings
• No partial refunds are provided for unused portions of subscription periods

Refunds

Refund requests must be submitted through the Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

Free Trial

We may offer free trial periods for Kiddio Pro subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription at the then-current rate.

AI Usage Limits

AI-powered features (recommendations, chat, weekly planner) are subject to daily and monthly usage limits based on your subscription tier. These limits help us manage costs and ensure service availability for all users.

5. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the App, its systems, or other users' accounts
• Interfere with or disrupt the App's functionality or servers
• Scrape, data mine, or extract data from the App without our written permission
• Create multiple accounts to circumvent usage limitations or abuse free trials
• Share your account credentials with others or allow unauthorized access
• Use automated systems, bots, or scripts to access the App
• Reverse engineer, decompile, or disassemble any part of the App
• Submit false, misleading, or fraudulent information
• Harass, abuse, or harm other users or activity providers
• Use the AI features to generate inappropriate, harmful, or illegal content

6. Activity Information Disclaimer

Activity details including schedules, prices, availability, locations, age requirements, and registration status are provided by third-party activity providers. This information may change without notice. We strongly recommend:

• Always verifying activity details directly with the provider before registering
• Confirming current pricing and availability
• Reviewing the provider's own terms, policies, and safety requirements
• Contacting the provider directly for any questions or special accommodations

We are not responsible for:

• Cancellations, schedule changes, or modifications made by activity providers
• Inaccurate information displayed in the App
• Issues with third-party activity registration or payment
• The quality, safety, or suitability of any activity
• Any injuries, damages, or losses arising from participation in activities

Registration and payment for activities are handled directly by the activity providers through their own systems, not through our App. When you click a registration link, you leave our App and interact directly with the provider.

7. AI-Powered Features

Our AI features use artificial intelligence to provide personalized recommendations, conversational assistance, and schedule planning. By using these features, you understand and agree:

• AI recommendations are suggestions based on your preferences and are not guaranteed to be suitable for your family
• AI responses may occasionally contain inaccuracies or outdated information
• You should verify all AI-provided information with the actual activity provider
• AI features are subject to usage limits based on your subscription tier
• We may modify, improve, or discontinue AI features at any time
• Your interactions with AI features may be logged for service improvement

The AI features are designed to assist with activity discovery and are not a substitute for parental judgment regarding the safety and appropriateness of activities for your children.

8. Family Sharing

Pro subscribers can share child profiles with other family members. By using family sharing features:

• You represent that you have the authority to share child profile information with invited family members
• You are responsible for managing sharing permissions and can revoke access at any time
• Invited users must create their own Kiddio accounts to access shared profiles
• You can grant view-only or edit access to shared profiles
• Shared users can see child preferences, favorites, and calendar events for shared children

9. Intellectual Property

The App, including its design, features, content, and functionality, is owned by 4our5ive Software Inc. and is protected by copyright, trademark, and other intellectual property laws. The Kiddio name, logo, and related marks are trademarks of 4our5ive Software Inc.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, copy, or distribute the App or its content
• Use the App for commercial purposes without our written consent
• Remove any copyright or proprietary notices
• Transfer your license to any third party

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information, including information about your children. By using the App, you consent to our data practices as described in the Privacy Policy.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 4OUR5IVE SOFTWARE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, goodwill, or other intangible losses
• Service interruptions or App unavailability
• Computer damage, system failures, or data loss
• Any damages arising from your use of or inability to use the App
• Any damages related to third-party activities discovered through the App
• Reliance on AI recommendations or information provided by the App
• Unauthorized access to your account or data

Our total aggregate liability for any claims arising from your use of the App shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty Canadian dollars (CAD $50).

12. Disclaimer of Warranties

THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any defects will be corrected
• Activity information will be accurate, complete, or current
• AI recommendations will be suitable for your family
• The App will meet your specific requirements

13. Indemnification

You agree to indemnify, defend, and hold harmless 4our5ive Software Inc. and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit or share through the App
• Your participation in activities discovered through the App

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App, updating the "Last Updated" date, and for significant changes, sending a notification through the App.

Your continued use of the App after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you should discontinue use of the App.

15. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. This includes adding or removing features, changing subscription tiers or pricing, and modifying AI capabilities. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Vancouver, British Columbia, Canada, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to waive any right to a jury trial or to participate in a class action.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 4our5ive Software Inc. regarding your use of the App and supersede any prior agreements, communications, or understandings.
